1 0 Utilities cannot recover increased tax expenses By Jim Babco*ck Journal Herald Staff Writer Ohio's electric and gas utility companies will have to wait their turns to recover millions of dollars in new expenses caused by a 1-percent increase in the state's gross receipts tax. The Public Utilities Commission of Ohio decided that yesterday by refusing to allow the utilities to adjust their current tariffs in order to immediately recover the tax payments. "The commissioners decided that the best place for treatment of the increased taxes is in rate relief proceedings," said Ray Ratchford, commission information specialist. "They will review the circ*mstances for each individual company as its next rate case comes up." The utilities, including the Dayton Power and Light had argued that they should be allowed to recover increased taxes immediately because their earnings are being affected now. "We want to recover costs.

Currently we are taking this as an expense and not charging our customers, and therefore not recovering our funds. The purpose of this case was to to end that problem," said Susan Metzler, media relations coordinator. Metzler said the tax increase is costing $6 million annually. Ratchford said costs will be dealt with during proceedings on the company's request for a 22.5-percent, $108 million revenue increase. Hearings on that request are now under way in Columbus, and a decision is expected by July.

The gross receipts tax is an excise tax on the revenues of all corporations doing business in Ohio. The 1- percent increase was enacted in December as part of Gov. James A. Rhodes' temporary tax 1 program for rescuing the state from a financial crisis. Since the tax hike went into effect Jan.

1, the Cincinnati Gas and Electric the Ohio Edison Co. and the Cleveland Electric Illuminating Cc. have been granted rate increases that include recovery of the tax costs. is one of five utilities not yet recovering the tax increase. Dayton OKs noise ordinance The Dayton City Commission yesterday passed an ordinance prohibiting motor vehicle noise louder than 80 decibels.

Decibels are a measurement of sound intensity. The American National Standards Institute has determined noise levels above 80 decibels are excessive. The ordinance, aimed primarily at cars without mufflers, becomes effective June 11. It is patterned after similar legislation passed in Kettering and Trotwood. Violation of the law carries a penalty of up to 30 days jail and a $250 fine.

The city plans to spend $2,100 for two portable meters to measure noise from vehicles operating within city limits. The city already has ordinances prohibiting "loud, unnecessary or unusual noise" from radios, phonographs or musical instruments. These laws are sporadically enforced, said Police Director Grover W. "It gets down to the personal opinion of the person who has been cited vs. the police officer." The noise meters will make enforcement of the vehicle noise law easier because it "will give the officer credence," O'Connor said.

In other action, commissioners: Informally approved plans for the city's summer youth employment program. The program, funded by a $1.28 million grant from the Labor Department, will provide subsidized jobs and job training for 1,800 youths from poor families in Dayton. Lawrence C. Nelson, director of job development and training, said proposed cuts in the federal budget could reduce the program's funding by up to 75 percent next year. Agreed to pay the Dayton Power and Light Co.

$66,075 to extend electricity and gas lines to the proposed expansion of the Emery Air Freight terminal at Cox International Airport. Emery eventually will repay the city. Approved contracts negotiated last month with two units of the Dayton Public Service Union. Moonshine victim walks away A 28-year-old Blanchester man is "blind in one eye and can barely see out of the other" from suspected methanol poisoning after drinking "moonshine" last week, Blanchester Police Chief Richard Payton said yesterday. But Gary Berchtold, 119 Central walked out of Cincinnati General Hospital this week without being discharged, a hospital spokeswoman said.

And it is unknown yet whether his loss of sight is permanent. Berchtold is one of eight persons including two juveniles who were hospitalized last week for poisoning after drinking a clear liquid at a party last week at the Central Avenue address. Another Blanchester man who drank the liquid Dearl Noland, 35, of 218 Highland Ave. died Saturday at the Veterans Administration Hospital in Dayton. An official cause of death has not been determined by the Montgomery County coroner.

All other victims have been released from various hospitals after being treated for methanol poisoning. Payton said they suffered from vomiting, diarrhea, abdominal cramps and numbness. Payton said yesterday the incident appears to be "an accidental poisoning," and that so far officials do not suspect foul play. It is believed the liquid was brought to Blanchester from a Cincinnati suburb in a plastic antifreeze container, which Payton said may have contaminated it. Payton said the state Liquor Control Department is trying to trace the liquid's origin, and the state Bureau of Criminal Identification and Investigation is performing tests on one pint of the liquid confiscated last week.
